Supreme Court to consider lawsuits on sanctions against Medvedchuk’s TV channels

On April 26, the Administrative Court of Cassation of the Supreme Court will consider three cases challenging the presidential decree of February 2 that had imposed sanctions against the Medvedchuk’s TV channels. This was said on April 26 on the Facebook page of the Supreme Court.

In particular, a court hearing is scheduled for 12:00 on the case №9901 / 42/21 on the claim of “Leader TV” LLC, on 14:00, on the case №9901 / 22/21 on the claim of a citizen who challenged this decree, and at 14:30, the judges will consider the case № 9901/34/21 on the claim of LLC "Novyny 24 hodyny" (TV channel NewsOne).

As IMI reported, on April 12, the Administrative Court of Cassation within the Supreme Court started considering the claim of the TV channel "112 Ukraina" (LLC "Teleradiocompany" 112-TV ") to challenge the sanctions.

On February 26, the Supreme Court received lawsuits from “Leader TV” LLC to appeal against  the presidential decree (case registration number - 9901/42/21), as well as from New TV Format LLC (№ 9901/45/21).

The Supreme Court of Ukraine reminded that the claim from Novy TV Format LLC was received on February 26, and proceeding was opened on March 3. Subsequently, the court ruling of March 23 granted the SBU's request to extend the procedural deadline for submitting evidence and explanations to the court on the claim of Novy TV Format LLC. These materials were sent to the SBU by mail on April 4 and were not received by the court at the time of the hearing.

In addition, on April 6 the court is to consider the case №9901 / 54/21 after the claim filed by TV “Vybir” LLC. Also this day the court is to consider an administrative case № 9901/39/21 on the claim of Taras Kozak to declare sanctions illegal.

The court hearing on the case № 9901/47/21 on the claim of Ariadna TV LLC is scheduled for April 7. Case № 9901/40/21 on the claim of 112-TV Television and Radio Company (112 Ukraine TV channel) is scheduled for April 12.

The case № 9901/51/21 on the claim of LLC “Partner TV” is scheduled to be considered on April 15. As of April 19 the court is to consider the case № 9901/33/21 on the claim of LLC "Telecommunications Company" New Communications "(TV channel ZIK) and on the case № 9901/22/21 on the claim of a citizen who challenged the decree.

The case № 9901/42/21 on the claim of LLC “Leader TV” and the case №9901 / 34/21 on the claim of LLC “News 24 Hours” (NewsOne TV channel) will take place on April 26.

As IMI reported, on February 2, Volodymyr Zelensky has enacted the National Security and Defense Council decision of February 2, 2021 on the application of sanctions against MP Taras Kozak and television channels 112 Ukraine, NewsOne, and ZIK, the press service of the President's Office has reported.On February 25, the Administrative Court of Cassation received a lawsuit from 112-TV Television and Radio Company (112 Ukraine) appealing to the Presidential Decree of February 2 to impose sanctions on him.

As IMI reported, on February 11, the Cassation Administrative Court within the Supreme Court opened proceedings in one of the cases on the claim for sanctions against TV channels "112 Ukraina", NewsOne, ZIK.

On February 9, the Administrative Court of Cassation of the Supreme Court refused to institute proceedings over a claim requiring to declare illegal and revoke the decree of the President of Ukraine on the implementation of the decision of the National Security and Defense Council on sanctions against three TV channels.

The second lawsuit, which also challenges the presidential decree, was left without action by the Supreme Court and the plaintiff was given 10 days to remedy the deficiencies. 

On February 8, the Supreme Court of Ukraine received another lawsuit from an individual against the President Volodymyr Zelensky demanding that the decree imposing a decision of the National Security and Defense Council on sanctions against 112 Ukraine, NewsOne, and ZIK be declared illegal.

On February 4, two lawsuits were filed with the Supreme Court against the decree of the President of Ukraine on the application of sanctions against MP Taras Kozak and TV channels 112 Ukraina, NewsOne and ZIK.
