MP Shufrych proposed to amend right of National council to penalize for language of hatred
The Speaker of the Verkhovna Rada Committee on Freedom of Speech Nestor Shufrych has registered at the Parliament the bill No. 3079 , which proposed to amend the powers of the National Council to penalize for hate speech.
The Bill “On Amendments to Part 8th of Article 72 of the Law of Ukraine“ On Television and Radio Broadcasting ” was registered in the Parliament on February 18.
At the same time, there is no text of the draft law on the parliament website and this is unknown what changes are proposed to be introduced to the part eight of Article 72 of the Law of Ukraine “On Television and Radio Broadcasting”.
Actually, this provision is now, as follows:
“8. The National Council may decide to recover the fines specified in this part, irrespective of the application of sanctions to the offender in the form of a warning, only in the case of the following violations:
by broadcasting organizations -
25 percent of the license fee for:
-calls for a violent change in Ukraine's constitutional order;
-calls for an outbreak of aggressive war or propaganda and / or incitement to national, ethnic or religious hatred and enmity;
-promotion of the exclusiveness, superiority or inferiority of persons on the grounds of their religious beliefs, ideology, belonging to a particular ethnic group or race, physical or property status, social origin;
by software service providers -
25 percent of the license fee for:
-retransmission of programs and broadcasts concerning which the National Council has decided that its content didn’t meet the requirements of the legislation of Ukraine in accordance with Article 42 of this Law;
-retransmission of programs and broadcasts prohibited and / or restricted by the court.
In the case of calls for violent change of the constitutional order of Ukraine, unleashing of aggressive war or its propaganda and / or inciting national, ethnic or religious hatred and enmity, propaganda of exclusiveness, superiority or inferiority of persons on the grounds of their religious beliefs, ideology or other nation or race, physical or property, social background were broadcast, diffused, diffused without prior notice, and contained in speeches, remarks of persons who are not employee of a broadcasting organization, the broadcasting organization shall not be liable for these violations, except the cases where the employees of the broadcasting organization did not take measures to stop the offense in live broadcasting. "
