Court of appeals acquitted head of Administration of Ports for failure to provide information to “No to Corruption!”

Court of Appeals of Kyiv cancelled the judgment of Shevchenkivskyi district court that judged head of State Enterprise “Administration of Seaports of Ukraine” Raivis Vetskagans guilty of not providing information to the journalist of “No to Corruption!”, and closed the case, failing to find administrative offense in the actions of the official. This was reported by the representative of Parliamentary High Commissioner for adherence to the right for information, and of the Constitutional Court agency, Iryna Kushnir, “No to Corruption!” informs. The media outlet reminded that in 2017 the High Commissioner responded to the address of journalist on non-providing by the head of Seaports Administration of requested information on job description and salary of honorary president of Odesa Sea Trade Port Mykola Pavliuk, explaining that the information was confidential. Vetskagans was accused of administrative offense then, for violation of the Law “On Access to Public Information”. In September of 2017, the court judged the official guilty, but left him without any punishment, and the case was closed due to expiry of administrative penalty. After this, Vetskagans decided to go to the Court of Appeals. In his appeal, he pleads guilty of failure to provide information, but argues that the first instance court was not supposed to process the case after five months lapsed. The court of Appeals judged in favor of the official. At that, the media outlet pointed out that Mr. Raivis Vetskagans still has not provide the requested information to “No to corruption!”.
