Parliament’s personnel department refused to provide information about monthly bonuses of officials

 The Personnel Department of the Verkhovna Rada refused to give Ukrayinska Pravda journalist Serhiy Leschenko copies of orders on establishing monthly bonuses for the heads of parliamentary factions, indicating that the required data is classified information. This response was received by the journalist to his request to the head of the department Vitaly Maksym'yak, Leshchenko said on his page in Facebook.

"At your request of 31 January 2013 concerning the provision of copies of instructions to establish monthly bonuses to the heads of parliamentary factions, we announce the following. According to Article 19 of the Constitution of Ukraine, government agencies and local governments and their officials are obliged to act only on the basis and within the limits and in the manner provided by the Constitution and laws of Ukraine.

According to Article 32 of the Constitution of Ukraine, it is prohibited to collect, store, use and disseminate confidential information about a person without their consent, except in accordance with the law, and only in the interests of national security, economic prosperity and human rights.

Under the provisions of Articles 2, 5 Law of Ukraine "On Protection of Personal Data" Personal data (information or set of information about an individual who is identified or can be specifically identified), the access mode assigned to classified information, and accordingly to Article 14 hereof dissemination of personal data without the consent of the subject of personal data or authorized person permitted in cases determined by law, and only in the interests of national security, economic prosperity and human rights.

In this regard the deputies of Ukraine, heads of parliamentary factions were sent letters asking for their consent to provide the requested information," - says the head of the department of answers.

IMI media lawyer Roman Golovenko notes that the VR apparatus had to provide copies of such orders, and the information about the recipients of budget funds cannot be kept secret.

"Information about the recipients of budget funds cannot be kept secret (Part 5 of Art. 6 of the Law" On Access to Public Information "). This is a special rule and it should be used, as the provisions of the Law "On protection of personal data" are common about it. The refusal is not final, heads of factions may not mind, "- said the lawyer.
