Journalist of Kremenchug Telegraph won case for access to information

Journalist of the Kremenchug Telegraph (Poltava region) Tetyana Donchenko won the case at court of first instance over the access to information on the reconstruction of kindergartens in Kremenchug. The journalist wrote it in her blog.

“I feel like I got off the ground, the feeling is growing that my actions are "opening the curtains". They remind the city authorities that their actions should be transparent and accountable to the community. And not to some of its representatives - and on the instructions of the mayor, " she wrote. 

In September 2021, Tetyana Donchenko filed a lawsuit against the Kremenchug Municipal Energy Service Company (KP KMEK) for refusing to provide information at the request for information. The refusal was motivated by the fact that the contract for thermal modernization of public buildings worth 10 million euros was not public information. 

The Poltava District Administrative Court of First Instance ordered the utility to provide the requested information. 

“I have not yet received a paper decision of the Poltava District Administrative Court. But the text (from January 10, 2022) is available in the Unified State Register of Court Decisions, ”the journalist said. 

The court ordered the Kremenchug Municipal Energy Service Company of the Kremenchug City Council of Poltava Region to provide public information at the request of the journalist, and the utility company must reimrurse the court fees (908 hryvnias or about$32) to Tetiana Donchenko. 

As IMI reported, the managing editor of the Kremenchug Telegraph, Tetyana Donchenko, was refused to get information on repair work in the city's kindergartens from the Kremenchug City Council. She requested documents related to the use of public funds (namely, EBRD funds provided under the guarantee of the Kremenchug City Council), ie an agreement between KMEK and the executor of the project "Improving the energy efficiency of public buildings in Kremenchuk" - LLC "MMS Art-Projet" ; as well as information on the status of the contract for the 1st and 2nd quarters of 2021.
