Constitutional Court started considering the case about jurisdiction of National Council over TV and Radio broadcasting related to assigning penalties to them

The Constitutional Court of Ukraine started consideration of the case related to compliance with the Constitution of paragraph 1, part 10 of Article 72 of the Law of Ukraine “On TV and Radio broadcasting”, according to which the amounts of penalties for violation of the legislation are set by the National Television and Radio Broadcasting Council, with consent of the Cabinet of Ministers. The Constitutional Court started consideration of the law on June 7, as the Court’s website notifies.

The Constitutional Court was addressed by 49 MPs with a request to adjudge unconstitutional the paragraph in question, as it in fact makes possible administrative responsibility (penalty) to be imposed not by law, but by a decision of a governmental agency.
